How often does a fire risk assessment need reviewing?
The law requires the assessment to be kept up to date rather than renewed on a fixed date. In practice most premises are reviewed annually, and always after a change of layout, occupancy or use.
Who is the responsible person?
For a workplace it is the employer. For other premises it is whoever has control, which is usually the owner, landlord or managing agent. In shared buildings more than one person can hold the duty at the same time.
Do I need a written assessment?
If you employ five or more people, hold a licence, or have an alterations notice in force, the significant findings must be recorded in writing. In every other case a written record is still the only practical way to prove you complied.
What happens if I do not have one?
Enforcement ranges from a notice requiring action through to prosecution. Fines under the Fire Safety Order are unlimited, and serious cases have resulted in custodial sentences for the responsible person.
